Distance Selling Policy John W Hannay & Co Ltd. 1. These terms and conditions apply to all transactions between yourself, the (“Customer") and John W Hannay & Co Ltd – incorporating MustDestroy.com (“Supplier”). We may amend these terms from time to time, and you will be notified of any amendments by a notice on our web site. 2. No contract shall exist between you and John W Hannay & Co Ltd - incorporating MustDestroy.com until John W Hannay & Co Ltd - incorporating MustDestroy.com has sent you an email or other document confirming receipt and acceptance of any order you wish to place. Prior to confirmation of the contract you will be notified of any inaccuracies in price or descriptions and you will be entitled to cancel your order and receive a full refund. After confirmation John W Hannay & Co Ltd - incorporating MustDestroy.com is entitled to withdraw from any contract in the case of obvious error or inaccuracy regarding the order confirmation, or goods themselves and services offered. 3. Customers who shop on-line must be 18 years or over. When you purchase goods or services from John W Hannay & Co Ltd - incorporating MustDestroy.com you will be asked to provide your name, email address, billing address, delivery address, telephone number and credit or debit card details. John W Hannay & Co Ltd - incorporating MustDestroy.com only accepts payment by Visa, MasterCard and Switch. 4. John W Hannay & Co Ltd - incorporating MustDestroy.com obligation to you is dependent upon the availability of goods and services and John W Hannay & Co Ltd - incorporating MustDestroy.com may place a restriction on the volume of goods or services ordered by one customer. 5. Prices shown on the web site are the prices for which John W Hannay & Co Ltd - incorporating MustDestroy.com will sell its goods or services at the time of display. Information concerning price and availability is subject to change without notice. Prices as displayed on our web sites includes delivery but are exclusive of VAT. VAT will be charged at the standard UK rate. All goods shall be supplied at the price detailed on the web site at the time of order. In the unlikely event that goods or services are unavailable, John W Hannay & Co Ltd - incorporating MustDestroy.com will send you notification and allow you the opportunity to cancel your order if John W Hannay & Co Ltd - incorporating MustDestroy.com has not done so itself already. 6. We will make every effort to fulfil and deliver orders within fourteen days. You will be advised by telephone and email if goods ordered are out of stock and the earliest delivery if outwith the fourteen days. You will be given the opportunity to cancel your order if the new delivery time is unacceptable to you. We cannot be liable for any delay in delivery or otherwise caused directly or indirectly by any one of the following, strikes, lockout, trade dispute, fire, accident (whether to personnel or machinery, material, equipment or apparatus), defective material, breakdown of machinery, power failure, failure of crop, fuel shortage, lack of availability of supplies or materials, adverse inclement weather, acts, restrictions, regulations, byelaws, prohibitions or measures of any kind on the part of any government, parliamentary or local authority, Act of God, force majeure or by any other cause whatsoever, whether or not similar to those listed above outwith our control. 7. Payment will be obtained by debiting your account on despatch of your order and not before. Title to the goods will pass to you upon payment in full. Risk in the goods will pass to you on delivery. At delivery a valid signature will be required from a member of your household, or Company if delivered to a Company address, who is aged 18 or over. At that point, the goods will be deemed delivered and you will be deemed to be the owner of the goods subject only to your rights set out elsewhere in these Terms and Conditions. 8. John W Hannay & Co Ltd - incorporating MustDestroy.com operate a policy of refund or exchange. You have the right to cancel your order within 7 working days beginning the day after receipt of your order provided we receive your cancellation in writing. Refunds shall be made within 30 days of the cancellation date irrespective of the goods having been delivered back to us. Where goods are unwanted you will be liable for the cost of returning the goods to us or having them collected for return to us. We recommend that you keep your certificate of posting receipt, as this is your proof of posting in the unlikely event that your parcel goes missing. In the case of faulty goods, we will use reasonable effort to replace them, but if a replacement is not possible or if we choose to cancel, we will refund the full amount paid by you and any reasonable and relevant loss including postage that you may have incurred associated with the faulty goods. This and the other terms contained in these terms and conditions are not intended to affect your statutory rights. 10. Colour, shape and scale accuracy of the display on our web site cannot be guaranteed as this depends on your computer. 11. All the design, text and imagery on the web site is the copyright of John W Hannay & Co Ltd - incorporating MustDestroy.com and Intelligent Waste Solutions Limited. This site may not be altered in any way or republished without permission from John W Hannay & Co Ltd - incorporating MustDestroy.com. 12. John W Hannay & Co Ltd - incorporating MustDestroy.com reserves the right to withdraw its web site facility without notice. 13. All transactions between you and John W Hannay & Co Ltd - incorporating MustDestroy.com are conducted over a secure area. We endeavour to respond to all complaints within 5 working days. You will be advised how long it will take to resolve your complaint and will be kept informed throughout the process. 15. The contract will be governed by Scottish law and all disputes submitted to the jurisdiction of the Scottish courts. 16. If for any reason part of these Terms and Conditions are declared unenforceable or void due to the effect that it has on other terms around it or in the context it appears it shall be for the courts to decide, where relevant, whether the validity of the remaining terms and conditions is affected. These Terms and Conditions shall be read in conjunction with all other information you find on our web site concerning our relationship. The Terms and Conditions do not affect your statutory rights. |
